These Terms of Service (“Terms”) govern your access to and use of Bref (bref.ing), an internal email “brefing” (digest) tool operated by [Leash legal entity name] (“Leash,” “we,” “us”). By using Bref, you agree to these Terms.
Acceptance and eligibility
By accessing or using Bref, you agree to be bound by these Terms. If you are using Bref on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You must be able to form a binding contract to use the service, and you may use Bref only for lawful business purposes.
Description of the service
Bref lets a team compose internal brefings, build lists of recipients, send those brefings by email, and view sending and engagement information such as open and read tracking. We may add, change, or remove features over time.
Your account
Bref uses passwordless magic-link sign-in. You are responsible for keeping access to your email inbox and your sign-in links secure, and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your authorization.
Acceptable use
When using Bref, you agree that you will not:
- Send spam or unsolicited bulk email.
- Send unlawful, infringing, deceptive, or harmful content.
- Violate applicable anti-spam and privacy laws, including, where applicable, CAN-SPAM, CASL, and the GDPR.
You are responsible for having a lawful basis and a genuine relationship to email your recipients — especially external recipients — and for honoring unsubscribe requests promptly. You are solely responsible for the recipients you add and the messages you send through Bref.
Your content
As between you and us, you (and your organization) own the content you create, upload, or send through Bref, including your brefings and recipient lists. You grant us a limited, non-exclusive license to host, process, transmit, and send that content solely as necessary to provide and operate the service on your behalf.
Subscription and billing
For paid plans: fees are billed in advance for the applicable subscription period and, unless otherwise stated, renew automatically for successive periods until cancelled. Fees are exclusive of taxes, and you are responsible for any applicable taxes. Except where required by law, fees are non-refundable. We may change our fees on reasonable notice, effective as of your next renewal.
Availability and “as is” disclaimer
Bref is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any email will be delivered.
Limitation of liability
To the maximum extent permitted by law, Leash will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of Bref. Our total aggregate liability arising out of or relating to these Terms or the service will not exceed the amounts you paid to us for the service in the twelve months preceding the event giving rise to the claim.
Suspension and termination
We may suspend or terminate your access to Bref if you breach these Terms, misuse the service (including sending spam or unlawful content), or fail to pay applicable fees. You may stop using Bref at any time. On termination, your right to use the service ends; provisions that by their nature should survive will survive.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify account users. Your continued use of Bref after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by, and construed in accordance with, the laws of [Governing law — state/country & venue], without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction and venue specified there for any dispute arising out of or relating to these Terms.
